FAIRWAY ONE TERMS OF USE

These Terms of Use (“Terms”) govern your use of the Fairway One mobile application and related services provided by KINNECKT™ (“KINNECKT,” “we,” “us,” or “our”). By downloading, accessing, or using Fairway One, you agree to these Terms. If you do not agree, do not use the app.

1. WHAT FAIRWAY ONE PROVIDES

Fairway One is a golf companion designed to help golfers find courses, view available course and tee information, estimate GPS distances, view weather, keep score, and understand golf rules in plain language. Features may vary by device, location, course, data availability, app version, and permission settings.

2. GUEST USE AND OPTIONAL ACCOUNTS

You may use core Fairway One features as a guest. If you choose to create an account, you agree to provide accurate information, keep your credentials secure, and notify us if you suspect unauthorized use. You are responsible for activity occurring through your account.

3. GOLF RULES AND LOCAL RULES

Fairway One explains golf rules for general information and convenience. It does not issue an official ruling and is not a substitute for the current official Rules of Golf, the Committee in charge of a competition, a referee, or the golf course’s posted local rules.

Local rules can change by course, hole, competition, season, or playing condition. A local rule shown in Fairway One applies only when it has been adopted by the course or Committee for the round being played. Posted notices, scorecards, starter instructions, and Committee decisions take priority over Fairway One.

When an answer affects a competition, penalty, score, handicap submission, or prize, confirm it with the Committee or an authorized rules official. Fairway One is not affiliated with or endorsed by the USGA or The R&A unless expressly stated.

4. GPS, YARDAGE, COURSE, AND WEATHER LIMITATIONS

GPS positions, mapped greens and hazards, tee information, yardages, course status, and weather are estimates based on device sensors and third-party data. They may be incomplete, delayed, inaccurate, or unavailable.

Always follow course signage, physical markers, staff instructions, weather warnings, and applicable safety rules. Do not use Fairway One as an emergency, storm-warning, or personal-safety service. Stop play and seek appropriate shelter or assistance when conditions require it.

You are responsible for confirming that electronic distance-measuring devices are permitted under the rules and local rules governing your round or competition.

5. SCORES AND HANDICAP INFORMATION

You are responsible for the accuracy of scores entered in Fairway One and for determining whether a score is acceptable for handicap purposes. Any handicap or performance estimate shown by Fairway One is informational and is not an official Handicap Index under the World Handicap System, GHIN, or another authorized handicap service unless expressly identified as such.

6. PERMISSION TO USE THE APP

Subject to these Terms, KINNECKT grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Fairway One on devices you own or control for lawful, non-commercial use.

You may not:

• Copy, modify, distribute, sell, rent, or sublicense the app except as allowed by law.

• Reverse engineer, decompile, or attempt to extract source code except where applicable law expressly permits it.

• Interfere with the app, its security, its servers, or another user’s access.

• Use automated systems to scrape, overload, or misuse the app or its data providers.

• Upload or submit unlawful, infringing, deceptive, abusive, or malicious content.

• Use Fairway One to violate golf-course policies, competition rules, or any law.

7. OWNERSHIP

Fairway One, its original design, software, branding, and content are owned by KINNECKT or its licensors and are protected by applicable intellectual-property laws. Third-party course data, maps, weather, golf-rule materials, trademarks, and linked content remain the property of their respective owners.

8. THIRD-PARTY SERVICES AND LINKS

Fairway One relies on or links to third-party services for functions such as authentication, course information, mapping, weather, speech recognition, and official rule references. We do not control those services and are not responsible for their content, availability, accuracy, or practices. Your use of a third-party service may be governed by that provider’s terms and privacy policy.

9. AVAILABILITY AND CHANGES

We may add, change, suspend, or discontinue a feature to improve the app, maintain security, comply with law, or respond to third-party service changes. We do not promise that every course, tee, hole, rule, or feature will always be available.

10. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, Fairway One is provided “as is” and “as available.” KINNECKT disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted or error-free operation.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, KINNECKT and its owners, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost data, profits, opportunities, or goodwill; inaccurate course or rule information; scoring errors; weather-related loss; personal injury; property damage; or inability to use the app arising from or related to Fairway One.

Where liability cannot legally be excluded, KINNECKT’s total liability will be limited to the greater of the amount you paid for Fairway One during the 12 months before the claim or US $100.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. SUSPENSION OR TERMINATION

You may stop using Fairway One at any time. We may suspend or terminate access if you materially violate these Terms, misuse the app, threaten security, or create legal risk. Provisions that by their nature should survive termination will remain in effect.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules, except where the law where you live requires otherwise. Any dispute that is not required to be heard elsewhere by law will be brought in a court with appropriate jurisdiction in Georgia.

14. CHANGES TO THESE TERMS

We may update these Terms as Fairway One changes. The revised Terms will be posted on this page with a new effective date. Continued use after the new Terms take effect means you accept the revised Terms where permitted by law.
